Global Special Humanitarian visa (subclass 202)
WORK RIGHT
- Lives in Australia as a permanent residence. This visa allows applicant to work, study and access Medicare.

GENERAL CRITERIA FOR VISA SUBCLASS 202
- Person needs to be proposed by an Australian citizen/permanent resident or an eligible New Zealand citizen either Business organization or Community organization as part of a Community Support Program.
- Proposer may have to pay for your travel to Australia if you are unable. The International Organization for Migration (IOM) offers a range of travel assistance for Global Special Humanitarian (subclass 202) visa holders. IOM also provide some assistance like travel booking, advice and support for family’s journey to Australia.
- Applicant must not have entered Australia on or after 13th august 2012.
- Must meet split family provision, proposer must have declared applicant in their application before their visa was granted.
- The client must be offshore during applying for the application.

Protection visa (subclass 866)

GENERAL CRITERIA FOR VISA SUBCLASS 866
- Must entered Australia legally on a valid visa, unauthorized maritime arrival does not allow but later are unable or unwilling to return the country of origin owing to a well-founded fear of being persecuted.
- The applicant be a refugee or meets the complementary protection criteria.
- The applicant has evidence to prove his identity and is not related to any terror or criminal activity.
- Applicants are not barred from lodging a permanent visa application.
- The applicant must not have held or hold Temporary Protection visa (subclass 785)/Temporary Safe Haven visa (subclass 449)/Temporary (Humanitarian Concern) visa (subclass 786) or Safe Haven Enterprise visa (subclass 790)
- Should provide any documents or evidence to support the relationship between every member of the same family unit included the application.
- Must meet Australia’s security requirements for the grant of a protection visa.
- Meet the health and proof of good character requirement.

GENERAL CRITERIA FOR VISA SUBCLASS 785
- The applicant has arrived in Australia illegally without a valid visa and is a refugee. Also, has not cleared the immigration on arrival, is unable to make a permanent protection visa 866, and can only apply TPV 785/SHEV 790.
- The applicant has held or hold Temporary Protection visa (subclass 785)/Temporary Safe Haven visa (subclass 449)/Temporary (Humanitarian Concern) visa (subclass 786) or Safe Haven Enterprise visa (subclass 790).
- The applicant be a refugee or meets the complementary protection criteria
- The applicant has evidence to prove his identity and is not related to any terror or criminal activity.
- The applicant is an unauthorized maritime arrival, has not cleared immigration on arrival, have not been refused a protection visa before and is not barred to apply for a second protection visa.
- Further, the applicant is not a national of two countries, or has been offered protection in a third country, or has ever a protection visa cancelled.
- The applicant does not hold or held a Humanitarian Stay (Temporary) (subclass 449) visa since last entering Australia or are a transitory person.
- Should provide any documents or evidence to support the relationship between every member of the same family unit included the application.
- The applicant is unable or unwilling to return to their country of origin owing to a well-founded fear of being persecuted.
- Must meet Australia’s security requirements for the grant of a protection visa.
