  • Age: Must be under 45 years unless exempt.

  • Must have skill in Skill Occupation List (SOL), 3 years of related work experience, and a positive skill assessment not older than 3 years.
  • Must have meet competent English language skill not older than 3 years. Exempt level of English as specified in labour agreement.
  • Education document, all academic records, and transcripts.
  • Must not had a visa cancelled or refused.
  • Have no debt to the Australian Government.
  • Meet the health and proof of good character requirement.

ENS ARE THREE MAIN TYPES OF VISA-STREAMS

  • Direct Entry stream: Applicant nominated by the standard business sponsor (SBS) employer, work with employer for at least 2 years.
  • Temporary Residence Transition stream: Applicant must be a holder of visa subclass 457 or subclass 482 and must have worked for that SBS employer for 3 years. Cost, other benefits and requirements are nearly the same as visa subclass 186.
  • Labour Agreement stream: Applicant currently work or will work; the standard business sponsor (SBS) must have a labor agreement with the Australian government and that occupation is mentioned in the agreement.

ASSESSMENT PROCESS FOR ALL STAGES

Criteria for business to become a sponsor:

  • Evidence is required to prove that the business is lawfully operating business and has a good record and regard to Australian laws.
  • Proof that Australian workforce is not neglected and that the position is genuine and is not a created one. Evidenced commitment to train the workforce (SAF LEVY.)
  • Financial documents like tax assessments and business evaluation for its gross and net asset worth.
  • Business plan or its future expansion vision draft, increase in business activity documents/evidence.

Nomination of the applicant to fill the short skill occupation positions:

  •  After approval of sponsorship business can nominate a candidate from overseas in his short skill position. In 186 sponsorship obligations are not required to nominate an applicant whereas, for 482/457 visa it is a mandatory requirement.
  • Nominee must hold relevant license/registration if required by their profession.
  • Nominated position must be available for at least two years, and position can be anywhere in Australia.
  • Employment must be full-time or 35 hours/week, Applicant also certifies that he has a genuine intention to fill the position for at least 2 years.
  • Employers must submit a copy of the proposed contract. Also, provides evidence that he can financially support/pay his employee for 2 years at least. Documents must be provided by a chartered accountant, professional/ fellow professional National Accountant to meet the financial capacity requirement criteria.
  • Terms and conditions of work must be attached with the application like, pay, hours of work, rotating roster, or other expectations from the employee.
  • Employer has the obligation to pay according to the annual market salary rate for that position in that region, in Australia. (Fair work act/ Enterprise act) (www.fairwork.gov.au)
  • Labour market testing needs to be done before nomination.

Nomination categories are as follows:

  • Direct Entry (DE) Stream allows businesses to employ overseas employees, along with those 482/457 candidates who do not qualify under the temporary residence transition stream.

  • No age limit.
  • Two (02) years of related work experience, and a mandatory positive skill assessment.
  • Must have meet certain standard of English language skill unless exempt or as specified in labour agreement.
  • Must maintain adequate arrangements for health insurance during stay.
  • Must not had a visa cancelled or refused.
  • Have no debt to the Australian Government.
  • Evidence to support your intention as a Genuine Temporary Entrant (GTE) criterion.
  • Meet the health and proof of good character requirement.

TSS ARE FOUR MAIN TYPES OF VISA-STREAMS

  • Short-term stream: Must be nominated by an approved standard business sponsor (SBS) in the occupation listed in Short-Term Skilled Occupation List (STSOL). But priority is given to occupation listed in Priority Migration Skilled Occupation List (PMSOL). And application must be made/start within 3 months of nomination approval.

General Skill Migration

These visas are designed to meet the skill shortage in Australia. A detailed list of skills shortage in current Australian labor market is released every year, and an applicant with occupation in this skill shortage list can apply for expression of interest (EOI) and for visa after being invited.
